A 23-year old Port Alberni man with mental and physical health problems was sent to jail on Friday after being found guilty of sexually assaulting a child.
Connor Meredith-Frain is autistic and suffers complex psychological issues, and lacks bowel and bladder control because of spina bifida.
Crown Counsel asked for two years plus a day which would have sent Meredith-Frain to prison, where it was argued there are better rehabilitation programs.
Defence asked for a 2 year community sentence order, saying prison would constitute cruel and unusual punishment.
Judge Wolf sentenced him to 2 years less a day in provincial jail, which could mean he’ll be released within 16 months.
