Closing arguments yesterday in the BC Supreme Court trial of Samantha Dittmer.
The 61-year old is charged with second degree murder in the shooting of her 37-year old son Jesse McPhee on August 29th, 2021 in their 18th Avenue home.
Crown Counsel Gordon Baines told the jury that the evidence was clear and they should have no difficulty in finding that Dittmer deliberately shot McPhee point-blank in the chest with a rifle.
He said the forensic pathologist along with firearms and blood spatter experts agreed with the case he laid out over the past 4 weeks.
In his final submission, defence lawyer Brian Coleman called McPhee’s death a tragic accident, saying the Crown failed to prove Dittmer’s guilt.
The decision now rests with the 7 men and 4 women on the jury who could present their finding to Justice Margot Fleming as early as today.
