Candace Servatius’ case against the Alberni School District is over, after the Court of Appeal upheld a previous decision against the parent.
Servatius launched the lawsuit after her children watched a school presentation on Indigenous spiritual practices at John Howitt Elementary School in 2015.
Lawyers provided by the Calgary-based Justice Centre for Constitutional Reforms, wanted the school district to apologize for infringing on the family’s evangelical beliefs and promise to not allow smudging or Indigenous prayers in schools.
Nuu-chah-nulth Tribal Council president Judith Sayers said she was deeply disappointed the case took 7 years to settle, and shows the challenges faced by First Nations in the school system.
The Justice Centre said they will not be paying Servatius’ court costs, which include the court costs of the school district.
